General

These Terms of Service apply to all visitors, customers and users of drinksalta.com.au.

These Services are operated by Shaw-X Labs Pty Ltd (ABN 58 701 242 999), trading as Drink SALTA, in Queensland, Australia. By accessing or using this website, you agree to be bound by these Terms of Service.

By placing an order through this website, you confirm that you are at least 18 years of age or have permission from a parent or legal guardian. SALTA products are intended for adult use only.

Products

SALTA products are TGA Listed electrolyte medicines (AUST L 527148 and AUST L 527157), manufactured under Good Manufacturing Practice (GMP) standards in Australia.

We may modify, discontinue or limit the availability of a product or flavour at any time.

We make every reasonable effort to ensure product descriptions, imagery, pricing and packaging information are accurate and current. Product presentation may vary slightly, and we cannot guarantee that colours displayed on your device will exactly reflect the physical product.

Nothing in this section limits your rights where a product does not match its description or otherwise fails to meet a consumer guarantee under the Australian Consumer Law.

Pricing

All prices are displayed in Australian dollars and include GST where applicable.

Complimentary standard shipping is available on Australian orders over $100, unless otherwise stated. Orders that do not meet the applicable threshold will incur the shipping charge displayed at checkout.

We may change our prices and promotional offers at any time. Changes will not affect orders that have already been accepted, except where there has been an obvious pricing or technical error.

If a product is displayed at an incorrect price due to an administrative or technical error, we may contact you to confirm whether you wish to proceed at the correct price or cancel the affected order and provide a full refund.

Orders

By placing an order, you are making an offer to purchase products from SALTA.

An automated order confirmation acknowledges that we have received your order. It does not necessarily mean that your order has been accepted.

We may refuse or cancel an order where reasonably necessary, including where:

• payment cannot be authorised
• an item is unavailable
• incorrect pricing or product information has been displayed
• we reasonably suspect fraud or unauthorised activity
• delivery is unavailable to the supplied address
• promotional conditions or order limits have not been met

If payment has already been received for an order we cannot fulfil, we will refund the applicable amount to the original payment method.

You will receive a separate email once your order has been dispatched.

Payment

We accept the payment methods displayed at checkout, which may include major credit and debit cards, Shop Pay and other available payment providers.

Payments are processed securely through Shopify Payments and other third-party payment providers. SALTA does not store or have access to your complete card details.

You are responsible for ensuring that all billing and payment information supplied is accurate and that you are authorised to use the selected payment method.

Shipping

Please refer to our Shipping Policy for information about dispatch, delivery timeframes, shipping costs, tracking and delivery conditions.

Delivery timeframes are estimates only and may be affected by circumstances outside our reasonable control.

Returns and Refunds

Please refer to our Return & Refund Policy for details regarding return eligibility, damaged or faulty products, and refund timeframes.

Our voluntary 30-day change-of-mind policy is provided in addition to, and does not limit, your rights under the Australian Consumer Law.

Accounts

If you create an account on our website, you confirm you're 18 or older and that the details you've provided are accurate and kept up to date. Keeping your login secure is your responsibility — if you ever suspect someone else has accessed your account, let us know straight away at enquiries@drinksalta.com.au so we can help sort it out.

Unless otherwise stated, all content appearing on drinksalta.com.au — including text, photographs, graphics, branding, logos, product names, artwork, videos, website design and product formulations — is owned by or licensed to Shaw-X Labs Pty Ltd.

Reviews, Submissions and User Content

Where you submit a review, testimonial, image, comment or other content to SALTA, you confirm that:

• you own the content or have permission to submit it
• it does not infringe another person's rights
• it is not unlawful, defamatory, misleading or offensive

Where you expressly provide content for publication, you grant SALTA a non-exclusive, royalty-free licence to reproduce, publish and display that content in connection with our business and marketing.

We may decline to publish or remove content where we reasonably believe it breaches these Terms, applicable law, or advertising requirements applicable to a TGA Listed medicine.

Our website may use or link to third-party platforms, including payment providers, shipping providers, social media services and other websites.

Third-party services are governed by their own terms and privacy policies. SALTA is not responsible for the content, availability or practices of third-party websites that we do not control.

Promotions and Complimentary Gifts

Promotions, discount codes and complimentary gifts may be subject to additional conditions, including eligibility requirements, order thresholds, stock availability and closing dates.

Unless otherwise stated:

• promotions cannot be combined
• complimentary gifts have no cash value
• promotional items are available only while stocks last
• only one complimentary gift may be supplied per eligible order
• promotions may not be applied retrospectively
• orders placed using a discount code, promotional pricing, or with a complimentary gift attached aren't eligible for a change-of-mind return or exchange

Any giveaway, competition or prize draw run by SALTA is subject to its own specific Terms and Conditions, published on our website at the time of entry.

Nothing in this section affects your rights under the Australian Consumer Law.

Prohibited Use

You must not use this website:

• for unlawful or fraudulent purposes
• to interfere with the website's operation or security
• to transmit malicious code
• to collect information about others without authorisation

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.

To the maximum extent permitted by law, SALTA is not liable for indirect, incidental, special or consequential loss arising from your use of this website or our products, except to the extent that such liability cannot lawfully be excluded.

Where our liability can lawfully be limited, it will be limited to the value of the order placed, to the extent permitted by applicable law.

Privacy

We are committed to protecting your personal information. Please refer to our Privacy Policy for information about how we collect, use, disclose and protect personal information.

Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

You may be entitled to a repair, replacement, refund or compensation where a product does not meet an applicable consumer guarantee. The available remedy will depend on the nature of the problem.

Consumer guarantees apply independently of any voluntary returns policy offered by SALTA.

Nothing in these Terms excludes, restricts or modifies any right or remedy available to you under the Australian Consumer Law.

Governing Law

These Terms are governed by the laws of Queensland, Australia. Any dispute arising from these Terms will be resolved in a court of competent jurisdiction in Australia.

Changes to These Terms

We may update these Terms of Service from time to time.

The revised Terms will take effect when published on this page and will apply to website use and orders placed after that time.

Where a change materially affects an existing order, we will not apply that change retrospectively in a way that removes rights already acquired by the customer.
