1. Introduction

This Privacy Policy explains how Shaw-X Labs Pty Ltd (ABN 58 701 242 999), trading as SALTA ("we", "us", "our"), collects, uses and discloses your personal information when you access or use drinksalta.com.au (the "Services"). We handle your information in accordance with the Privacy Act 1988 (Cth).

This Privacy Policy is incorporated into our Terms of Service. Any capitalised terms not defined here have the meaning given in our Terms.

Our online store is powered by Shopify, and payments are processed through Shopify Payments. The Shopify Privacy Policy applies to any personal information collected, stored and processed on Shopify's servers. We may also use this information for the purposes set out in this Policy.

2. What information do we collect, and how?

2.1 Information you provide directly

We collect information you give us when using our Services or contacting us, including your name, email address, delivery address, and phone number.

We may retain information where we reasonably believe it is necessary to comply with legal obligations, prevent unlawful activity, resolve disputes, enforce our Terms, or maintain accurate business records.

2.2 Automatically collected information

We automatically collect certain information from your device when you use our Services, including your IP address, browser and device type, the site you came from, the date and time of your visit, and cookies that help identify your browser.

2.3 Cookies

Our Services use cookies to recognise returning visitors and understand how our site is used. Cookies do not usually identify you personally. You can disable cookies through your browser settings, though some site functionality may not work properly if you do.

2.5 Meta Pixel

We use Meta Pixel, a tool that records certain interactions on our site — for example, opening a particular page or following a link — so we can see how our ads are performing, understand our audience better, and refine our advertising over time. Meta governs its own use of this data under its Business Tools Terms, which sit outside our control.

2.6 Payment processing

Payments are processed through Shopify Payments. We do not store or retain sensitive financial information such as credit card numbers. Shopify's handling of this information is governed by their own terms and privacy policy.

3. Why we collect and use your information

We use your personal information to:

• Provide and fulfil our Services, including processing and delivering your orders
• Communicate with you about your order, our products, and any updates to our policies
• Send you marketing communications where you have consented to receive them
• Improve and develop our website and products
• Protect our business, website and customers from fraud or misuse
• Comply with our legal and regulatory obligations, including those relating to SALTA as a TGA Listed medicine
• Display product reviews or testimonials you choose to submit
• Any other purpose disclosed to you at the time of collection, or with your consent

Reviews and Submitted Content

If you submit a product review, testimonial, or other content, this may be displayed publicly on our website. Please avoid including personal or sensitive information in anything you submit for public display.

Photography and Video at Events and Shoots

By attending SALTA-branded events or appearing in publicly accessible areas during our promotional shoots, you acknowledge that photography and video may be captured and used for marketing purposes, including on our website, social media, and paid advertising.

 

4. Use of AI tools

From time to time we may use AI-based tools internally — for example, to spot patterns in how the business is running, make our Services better, or make internal processes more efficient. A real person still reviews anything AI-assisted before it's relied on, and we take reasonable steps to keep any personal information involved secure. If you'd rather your information wasn't used this way, let us know via Section 12 and we'll action it — though this may mean we can't offer every part of our Service to you as fully.

5. How we store and protect your information

Your information is transferred and stored electronically via a secured connection, primarily on Shopify's servers, which may be located in various countries. By using our Services, you consent to your information being stored in this way.

We do what we reasonably can to keep your personal information safe, but it's worth knowing that no system for sending or storing data online is ever fully risk-free, and we can't promise it's impossible to breach.

We retain personal information only for as long as necessary for the purposes outlined in this Policy, or as required by law. As the sponsor of a TGA Listed medicine, we are required to retain distribution records for a period of five years, in accordance with our obligations under the Australian Register of Therapeutic Goods.

6. Who we share your information with

Your information may be shared with:

• Our staff and contractors involved in operating the business
• Shopify, and any other service providers who help us operate our website, process payments, or fulfil orders (such as our courier)
• Klaviyo, for the purpose of sending marketing and transactional emails. Klaviyo may process your name, email address, phone number (where provided), marketing preferences, website activity, products viewed, cart and checkout activity, purchase history, and your interactions with our emails and communications
• Regulatory bodies or authorities, where required by law
• Any party involved in a sale, merger or transfer of our business

Some of our service providers may store, process or access your information outside Australia, including providers such as Shopify, Klaviyo, and Meta Platforms. We take reasonable steps to ensure this is handled appropriately, though privacy laws in other countries may differ from those in Australia.

7. Third-Party Websites and Links

Our Services may contain links to websites or platforms operated by third parties. We are not responsible for the privacy practices, content, or security of any third-party websites or platforms. We recommend reviewing the privacy policy of any site you visit via a link from our Services.

8. Direct marketing

By signing up to our mail list or providing your contact details through our website, you consent to receiving marketing communications from us via email and, where applicable, SMS. You can opt out at any time by clicking "unsubscribe" in any email, replying "stop" to any SMS, or contacting us directly.

Where we rely on your consent to process your personal information, you may withdraw that consent at any time by contacting us — this won't affect any processing that occurred before you withdrew consent.

Our Services, and SALTA products, are intended for adults only. We do not knowingly collect personal information directly from anyone under the age of 18. If you are a parent or guardian and believe a minor has provided personal information to us without appropriate permission, please contact us at enquiries@drinksalta.com.au so we can assess and, where appropriate, delete the information.

You may request access to the personal information we hold about you, or ask us to correct or delete it, by contacting us using the details below. We will respond to your request as soon as reasonably practicable.

If you have concerns about how we've handled your personal information, please contact us in writing using the details below. If you're not satisfied with our response, you can lodge a complaint with the Office of the Australian Information Commissioner (OAIC).
